The Butte County Sheriff's Office is investigating whether one of its deputies went too far in making an arrest.
The last part of the incident was caught on camera by a witness.
The video shows Butte County Sheriff's Deputy Sam Burnett arresting Terry Collins in Oroville just before 11:00 a.m. Tuesday. In the footage, Burnett can be seen kicking Collins to the ground.
Sheriff's officials said Burnett spotted Collins walking along Meyers Street and recognized him as a suspect with an outstanding warrant. When Burnett approached Collins at the Southside Mini Mart, he allegedly started fighting the deputy. During the fight Burnett reportedly hit Collins with a baton, then kicked him in the shoulder when he refused to lay down on the ground.
That kick was captured on a cell phone camera from a passing vehicle. At the end of the video you can hear someone saying, "he was f---ing that cop up." Sheriff's officials said a physical altercation took place with Collins striking Deputy Burnett in the face and kicking the deputy in the lower body, according to a news release issued Tuesday night.
The Sheriff's Office started an internal investigation after learning about the video showing the last part of the arrest which had been posted on a Facebook account belonging to Shawnski Montana.
Collins was taken to Oroville Medical Center where he was treated for minor injuries to the left side of his face. He was then booked into the Butte County Jail on charges of battery on a peace officer, resisting arrest, resisting an executive officer, and for his outstanding misdemeanor warrant.
Burnett was also taken to the hospital and treated for a broken wrist and cuts and bruises on his face.
Officials say Burnett has been reassigned from patrol duty until the investigation is completed and his injuries are healed.
